Station Currency

With the December 9 patch, Everquest II is adding RMT:

STATION CASH

Station Cash is a new virtual currency from SOE that has been created to allow for the purchase of premium in-game items within EverQuest II.

To get started, access the “Marketplace” from the EQII Window within the game.  Click on the “Add Funds” button to purchase Station Cash to fund your wallet and then select items to purchase.

In addition, the EULA has changed.  Please make particular note of this bit:

YOU PROMISE, THEREFORE, THAT YOU WILL NEVER ASSERT OR BRING ANY CLAIM OR SUIT AGAINST SOE, ITS LICENSOR(S), ANY SONY COMPANY, OR ANY EMPLOYEES OF ANY OF THE ABOVE, WHICH IS RELATED TO OR BASED ON (I) A CLAIM THAT YOU “OWN” ANY VIRTUAL GOODS IN ANY GAME, (II) A CLAIM FOR THE “VALUE” OF VIRTUAL GOODS IF SOE DELETES THEM (AND/OR TERMINATES YOUR ACCOUNT(S)) IF YOU OR ANYONE ACTING IN CONCERT WITH YOU VIOLATES ANY PROVISION OF THE EXCHANGE AGREEMENT, THIS AGREEMENT, THE GAME’S RULES OF CONDUCT, SOE’S TERMS OF SERVICE AND/OR SOE’S PRIVACY POLICY (ALL OF WHICH ARE POSTED AT A LINK AT WWW.EVERQUEST2.COM), (III) A CLAIM FOR THE “VALUE” OF VIRTUAL GOODS THAT YOU MAY LOSE IF SOE DOES ANYTHING THAT IT IS ENTITLED TO DO PURSUANT TO ANY PROVISION OF THE EXCHANGE AGREEMENT, THIS AGREEMENT, THE GAME’S RULES OF CONDUCT, SOE’S TERMS OF SERVICE AND/OR SOE’S PRIVACY POLICY, OR FOR ANY MALFUNCTIONS AND/OR “BUGS” IN THE GAME, AND/OR (IV) A CLAIM THAT THE “VALUE” OF ANY VIRTUAL GOODS HAS INCREASED OR DECREASED BY VIRTUE OF ANY GAME MODIFICATION THAT SOE HAS MADE OR WILL MAKE . ALL OF THE ABOVE APPLIES WHETHER ON AN EXCHANGE ENABLED SERVER OR ON A NON-EXCHANGE ENABLED SERVER.

That’s right.  Log in and (according to SOE) you give up your right to assert that anything you buy/acquire in-game has an intrinsic “value”.  So later on, if they decide to alter the item in question and you get upset about it (especially if you paid real money for it), they’ll claim you agreed to that being fine.  Just a head’s up.

I’m already attempting to gain more information directly from SOE on this.  I hope to have more later this afternoon.

This is major. And the fact that they have re-written the EULA. Talk about a company trying it’s best to get all the cash it can, and not offer any security to the player.

    Ouch

Sony is opening up a major can of worms here…

The EULA issue is something to avoid all the crazy legal trouble they would be under if this was declared an actual “Product” that they would be legally responsible for.

Its almost the same when you buy Wii points, or do anything where you get an online ‘currency’ to spend on things. you have to agree to an EULA to even do anything there. Half the time you don’t even see it, as the mere act of opening the game agrees to twenty pages of gobbledygook.

I think it would be a bigger benefit to have legal agreements written out in “Common Language” and do away with the shrinkwrap EULA agreements. Have some more common sense introduced into these situations.

They’ve always had the text about not being able to claim a “value” on the items if they change the game. That’s been in there from day one. But.. since I don’t have a snapshot of it from before today, I can’t prove that it did.

I’m sure they did change the EULA, just not -that- spot.

When somebody asks, “Who reads the EULA?” I am going to say “Kendricke!” from now on.
